1. Copyright Ownership

Northern Lights Alaska (NLAK) respects the intellectual property rights of others and expects its users to do the same. All content, features, functionality, design, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and other materials on the NLAK website (collectively, "Content") are the exclusive property of NLAK or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Unauthorized use, reproduction, distribution, modification, or display of NLAK's Content is strictly prohibited and may result in civil and criminal penalties.

2. Digital Millennium Copyright Act (DMCA) Notice

NLAK complies with the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide NLAK's Copyright Agent with the following information in writing:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit NLAK to locate the material
  4. Information reasonably sufficient to permit NLAK to contact you, such as an address, telephone number, and, if available, an electronic mail address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

3. DMCA Takedown Procedure

Upon receipt of a valid DMCA notice, NLAK will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who posted the material of the removal
  • Provide the user with a copy of the DMCA notice
  • Inform the user that they may submit a counter-notification if they believe the material was removed in error

4. Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with NLAK's Copyright Agent. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which NLAK may be found, and that you will accept service of process from the person who provided the DMCA notice or an agent of such person

5. Repeat Infringers

NLAK will terminate, in appropriate circumstances, users who are repeat infringers of intellectual property rights. NLAK reserves the right to terminate access to the website for any user who repeatedly infringes the intellectual property rights of others.

6. False Claims

WARNING: Any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by NLAK, who is injured by such misrepresentation.

8. Third-Party Content

NLAK displays space weather data provided by the NOAA Space Weather Prediction Center, which is in the public domain. NLAK does not claim copyright ownership of public domain data. However, NLAK's compilation, arrangement, presentation, and original analysis of such data may be protected by copyright.

9. Fair Use

The fair use of a copyrighted work for purposes such as criticism, comment, news reporting, teaching, scholarship, or research is not an infringement of copyright. However, the determination of whether a particular use is "fair use" depends on the specific circumstances. If you are unsure whether your use of NLAK's Content constitutes fair use, you should consult with an attorney.

10. Trademark Notice

"Northern Lights Alaska," "NLAK," and related marks are trademarks of Northern Lights Alaska. Unauthorized use of these trademarks is strictly prohibited and may violate trademark laws.
